Policy/Community Agreement

This is an agreement between the Hacksburg, a Virginia nonstock corporation ("Hacksburg"), and you, the member ("You").

This agreement limits our liability and imposes terms on your ability to take legal action against us. You are advised to read the entire document.

Use of Hacksburg Resources

You are permitted to use Hacksburg's common resources, including its online resources, subject to the policies Hacksburg imposes on their use. These policies include, but are not limited to, this Community Agreement, the Space Rules, and relevant safety policies.

You agree that your membership in Hacksburg does not give you any ownership stake in Hacksburg's common equipment.

Housing of Equipment and Property

Hacksburg offers several ways to store equipment and property within Hacksburg's space. All equipment and property stored within its space is subject to Hacksburg policies. Hacksburg cannot guarantee the safety or security of your equipment or other property so housed within its space. As such, you agree to hold harmless Hacksburg, its directors, officers, and members in the event of theft or damage of said property.

Guests

Members are permitted to bring guests into the space per the Space Rules, as long as they are accompanied by you at all times while they are in the space. Guests must adhere to all of the same rules and restrictions as members. You agree to take full responsibility for the conduct of the guests you bring into the space.

Guests must:

• be a minimum of 8 years old.
• sign a liability waiver.
• not use equipment unless they are assisting the member with the operation of the machine.
  • For example, a second individual may assist in pulling a piece of lumber through the planer.

Responsibilities

As a member of Hacksburg, You have a duty, while interacting with Hacksburg or its members, to conduct Yourself in a manner that does not endanger Hacksburg or your fellow members.

No illegal activity

You agree not to use Hacksburg's resources, including the use of the space or any online resources, to instigate, facilitate, or otherwise contribute to, any activities in violation of local, state, or federal laws, rules, or regulations.

Firearms and Firearm manufacturing

All work on firearms, as defined by Hacksburg in section 1 below, is strictly prohibited unless specifically exempted in section 2.

• “Firearm” within this policy is deliberately far broader than most legal definitions
• "Work" or "Working" on a firearm means creating, modifying, or assembling section 1 item(s) together with other section 1 item(s) or section 2 item(s)

Violation of this policy may lead to expulsion from Hacksburg and/or filing a criminal complaint with the relevant authorities.

Section 1: Work or manufacturing of the following items is explicitly and strictly prohibited:

1. Firearm: a device that expels a projectile or projectiles by means of a deflagrating propellant (i.e. the deflagration or detonation of gunpowder or other similar propellant). This includes not only the BATFE definition of a firearm - its receiver - but also firearm-specific components that attach to a firearm (unless specifically exempted in section 2) including but not limited to barrels, cylinders, magazines, charging handles, safeties, buffers, actions, barrel bushings, linkages, extractors, firing pins, trunions, recoil springs, gas blocks.
2. Realistic Replicas: Replicas which a reasonable person might consider a functioning firearm upon inspection.
3. Suppressors or Silencers: Reduce the sonic concussion of expelling a projectile or projectiles
4. Reloading: All activities associated with the production of ammunition, including but not limited to processing primers, gunpowder/propellant, cases, and projectiles

Section 2: Work or manufacturing of the following firearm-related items are exempted, subject to conditions:

1. Devices that expel a projectile or projectiles by non-deflagrating propellant means: Examples include springs, compressed air/gas, electronic, mechanical action. Not exempted are components interchangeable with firearms as defined in the previous section.
2. Slings: Slings and sling attachments opposite point of attachment to the firearm
3. Fasteners and commodity hardware: Standard components used on firearms not specific to firearms
4. Sights: Scopes, sights, lasers, flashlights, etc not integral to the firearm
5. Bipods: And other firearm supports if removable without tools
6. Stocks and grips: May be made, refined, or modified at Hacksburg
7. Props: Non-firearm devices that do not closely resemble actual firearms such as sci-fi, fantasy, steampunk creations, and replicas that are clearly not capable of firing a projectile or projectiles. Must not include devices from section 1.

Section 3: Checking the fit of exempted items (i.e. stock, sling, sights, etc) from section 2 to a firearm in section 1 at Hacksburg is prohibited. Section 2 items may be separated from Section 1 items at Hacksburg, however they are not to be attached at Hacksburg.

Section 4: The open carrying of firearms is strictly prohibited. Concealed carry is allowed if the individual has a proper permit issued by a government entity.

Harassment

Harassment of any form is not allowed in Hacksburg. Harassment is unwelcome social or other behavior targeted at a person or group of people, including -- but not limited to -- physical assault, battery, deliberate intimidation, stalking, or unwelcome physical attention. If someone asks You to stop interacting with them, You agree -- and are expected -- to comply immediately. Hacksburg is not responsible for solving any interpersonal problems that may arise between individual members. If you feel that a threat exists against your person, we advise you to seek a restraining order against the person in question and to present it to the Board of Directors; otherwise, we recommend simply avoiding them. If a person harasses or attempts to assault You at the space or on Hacksburg's online spaces, You may report that individual to the Board of Directors and the appropriate action will be taken.

Conversely, any attempt to have an innocent person sanctioned by falsely accusing them of harassment will be itself treated as an act of harassment and will be dealt with appropriately. The responsibility for settling interpersonal disputes lies solely with the people involved, and Hacksburg will not tolerate being used as a leveraging point in such disputes.

No circumventing security measures

You agree not to disable, circumvent, or otherwise tamper with Hacksburg's security systems, including -- but not limited to -- the door lock mechanisms, monitoring systems, and online access restrictions. The Hacksburg Board will investigate these occurrences and may choose to discipline or terminate the membership of any member which violates this policy.

Responsible use of resources

You agree not to put an onerous burden on Hacksburg's resources. This includes, but is not limited to, using an inordinately large amount of the space's consumables, using excessive amounts of electricity, using large amounts of network bandwidth or disk storage space on Hacksburg's servers, etc. The Hacksburg Board will investigate these occurrences and may choose to discipline or terminate the membership of any member which violates this policy.

Safety

You agree to read and follow any and all safety policies for all equipment in the space. In addition, You agree to not use equipment without completing the proper safety training, and to obey any and all safety instructions from other members. The Hacksburg Board will investigate safety violations and may choose to revoke training status, discipline, or terminate the membership of any member which violates this policy.

Use of the space

You agree to follow the Space Rules at all times while in the space.

Commercial Use

1. Hacksburg is based on open source ideals and thus encourages its membership to embrace those ideals as well, however, members reserve the rights to all of their creations.
2. A Hacksburg membership is not a “work for hire” agreement and Hacksburg members are not employees of Hacksburg.
3. Hacksburg may invoice members for incurring costs to Hacksburg significantly in excess of their monthly dues. Hacksburg will notify the member at first when Hacksburg believes they are utilizing too much in resources and encourage them to purchase those resources themselves. After notification and the continuation of the unacceptable resource use, #Hacksburg may begin to invoice members for the cost of the resources. Failure to pay may result in membership cancellation.

Hacksburg does not allow any commercial automotive work of any kind at the space.

Intoxicating Substance Policy

The possession or consumption of alcoholic beverages, illegal drugs, or other intoxicating substances is prohibited anywhere on or within the premises, parking lot, or common walkways of Hacksburg.

Anyone suspected of being intoxicated or impaired will be asked to leave the premises immediately and may be subject to additional disciplinary action. Refusal to leave will result in a call to local Police.

Anyone observing this behavior should escalate to an officer or director. If there is not one present, a message should be sent to board@hacksburg.org with the date, time, location of the incident, name of the offender, witness names and any other relevant details.

Misrepresentation

You agree that being a member of Hacksburg does not entitle You to either speak on behalf of Hacksburg or to an endorsement by Hacksburg, and you agree not to make claims to that effect. In addition, You agree not to use Hacksburg's logo or other identifying marks in any way without permission from Hacksburg.

Disputes and Legal Jurisdiction

If you seek to file a legal claim against Hacksburg, you agree to file and resolve it exclusively in a state or federal court located in Montgomery County, Virginia. You also agree that the laws of the Commonwealth of Virginia and, to the extent applicable, the laws of the United States of America will govern this agreement, as well as any legal claim that might arise between You and us (without reference to conflict of laws principles). You agree to submit to the personal jurisdiction of, and agree that venue is proper in, the courts located in Montgomery County, Virginia, in any legal action or proceeding relating to Hacksburg or this agreement.

To ensure that disputes are dealt with soon after they arise, you agree that regardless of any statute or law to the contrary, any claim or cause of action You might have arising out of or related to use of Hacksburg services or this agreement must be filed within the applicable statute of limitations or, if earlier, one (1) year after the pertinent facts underlying such claim or cause of action could have been discovered with reasonable diligence (or be forever barred).

Severability

If any provision of this agreement is found to be legally unenforceable, then the remainder of this agreement not so affected shall remain in force.
