This is an agreement between the Hacksburg, a Virginia nonstock corporation ("Hacksburg"), and you, the member ("You").

This agreement limits our liability and imposes terms on your ability to take legal action against us. You are advised to read the entire document.

Rights

Voting

Members are entitled to a vote on decisions of Hacksburg as per the Bylaws.

Use of Hacksburg Resources

You are permitted to use Hacksburg's common resources, including its online resources, subject to the policies Hacksburg imposes on their use. These policies include, but are not limited to, this Community Agreement, the Space Rules, and relevant safety policies.

You agree that your membership in Hacksburg does not give you any ownership stake in Hacksburg's common equipment.

Housing of Equipment and Property

You may, subject to Hacksburg policy, house equipment and property, either on loan with Hacksburg or for your own use, within Hacksburg's space. Hacksburg cannot guarantee the safety or security of your equipment or other property so housed within its space. As such, you agree to hold harmless Hacksburg, its directors, officers, and members in the event of theft or damage of said property.

Guests

Members are permitted to bring guests into the space per the Space Rules, as long as they are accompanied by You at all times while they are in the space. Guests must adhere to all of the same rules and restrictions as members.

Responsibilities

As a member of Hacksburg, You have a duty, while interacting with Hacksburg or its members, to conduct Yourself in a manner that does not endanger Hacksburg or your fellow members.

No illegal activity

You agree not to use Hacksburg's resources, including the use of the space or any online resources, to instigate, facilitate, or otherwise contribute to, any activities in violation of local, state, or federal laws, rules, or regulations.

No harrassment

Harrassment of any form is not allowed in Hacksburg. Harrassment is unwelcome social or other behavior targeted at a person or group of people, including -- but not limited to -- physical assault, battery, deliberate intimidation, stalking, or unwelcome physical attentions. If someone asks You to stop interacting with them, You agree -- and are expected -- to comply immediately.

Hacksburg is not responsible for solving any interpersonal problems that may arise between individual members. If You feel that a threat exists against your person, we advise you to seek a restraining order against the person in question and to present it to the Board of Directors; otherwise, we recommend simply avoiding them. If a person harasses or attempts to assault You at the space or on Hacksburg's online spaces, You may report that individual to the Board of Directors and the appropriate action will be taken.

Conversely, any attempt to have an innocent person sanctioned by falsely accusing them of harrassment will be itself treated as an act of harassment and will be dealt with appropriately. The responsibility for settling interpersonal disputes lies solely with the people involved, and Hacksburg will not tolerate being used as a leveraging point in such disputes.

No circumventing security measures

You agree not to disable, circumvent, or otherwise tamper with Hacksburg's security systems, including -- but not limited to -- the door lock mechanisms, monitoring systems, and online access restrictions.

Responsible use of resources

You agree not to put an onerous burden on Hacksburg's resources. This includes, but is not limited to, using a inordinately large amount of the space's consumables, using excessive amounts of electricity, using large amounts of network bandwidth or disk storage space on Hacksburg's servers, etc.

Safety

You agree to read and follow any and all safety policies for all equipment in the space. In addition, You agree to not use equipment without completing the proper safety training, and to obey any and all safety instructions from other members.

Use of the space

You agree to follow the Space Rules at all times while in the space.

Guests

You agree to take full responsibility for the conduct of the guests You bring into the space.

Misrepresentation

You agree that being a member of Hacksburg does not entitle You to either speak on behalf of Hacksburg or to an endorsement by Hacksburg, and You agree not make claims to that effect. In addition, You agree not use Hacksburg's logo or other identifying marks in any way without permission from Hacksburg.

Disputes and Legal Jurisdiction

If You seek to file a legal claim against Hacksburg, you agree to file and resolve it exclusively in a state or federal court located in Montgomery County, Virginia. You also agree that the laws of the Commonwealth of Virginia and, to the extent applicable, the laws of the United States of America will govern this agreement, as well as any legal claim that might arise between You and us (without reference to conflict of laws principles). You agree to submit to the personal jurisdiction of, and agree that venue is proper in, the courts located in Montgomery County, Virginia, in any legal action or proceeding relating to Hacksburg or this agreement.

To ensure that disputes are dealt with soon after they arise, You agree that regardless of any statute or law to the contrary, any claim or cause of action You might have arising out of or related to use of Hacksburg services or this agreement must be filed within the applicable statute of limitations or, if earlier, one (1) year after the pertinent facts underlying such claim or cause of action could have been discovered with reasonable diligence (or be forever barred).

Severability

If any provision of this agreement is found to be legally unenforceable, then the remainder of this agreement not so affected shall remain in force.
